Call for Accountability Renewed in Lawsuit Over Access to Indiana Abortion Reports
New Thomas More Society Filing Urges Court to Throw Out Abortion Providers’ Case

South Bend, IN - In a new court filing, Thomas More Society redoubles its defense of Voices for Life’s right to access and review Terminated Pregnancy Reports (TPRs) to improve maternal health, ensure accountability, and uphold transparency standards for Indiana’s abortion industry.
The latest reply brief filed in the Indiana Court of Appeals, by Thomas More Society attorneys on behalf of Voices for Life, is on the heels of a new state report issued by the Indiana Department of Health recommending financial penalties for hospitals that fail to provide TPRs in accordance with state law.
In their report, the state health department found that Eskenazi Health and IU Health have refused to comply with state law and have stopped submitting completed TPRs. As previously reported, Drs. Bernard and Rouse, who have sued Voices for Life and the state to stop the release of TPRs, admitted under oath in an earlier court hearing that they also have failed to submit completed TPRs in at least one instance since December 2024.
“This case is not about protecting patient privacy as the abortion providers would lead the public to believe, but rather, it’s about abortion doctors’ desire for privacy from the vital public scrutiny made possible by the public’s review of Termination of Pregnancy Reports” said Pat Gillen, Senior Counsel at Thomas More Society.
Thomas More Society attorneys argue that Drs. Bernard and Rouse have no standing to block the release of TPRs and that a court order blocking release of the reports improperly undermines the legislative process in the state and exemplifies judicial overreach.
