Thomas More Society Continues to Lead the Fight to Repeal the FACE Act

Washington, DC - Thomas More Society celebrates the advancement of the FACE Act Repeal Act of 2025 (H.R. 598) by the House Judiciary Committee. Thomas More Society attorneys have been on the frontlines against the Freedom of Access to Clinic Entrances (FACE) Act, defending courageous pro-lifers who were unjustly prosecuted by the Biden-Harris Administration, successfully winning pardons from President Trump for 23 pro-life advocates who were convicted, and spearheading efforts in Congress to pass a full repeal of the unconstitutional FACE Act.

“Since its passage in 1994, I knew the FACE Act was not only unconstitutional but would have a profound and harmful impact on the pro-life community and our nation’s justice system,” said Andrew Bath, Executive Vice President and General Counsel at Thomas More Society.

“That all came to a head under the Biden-Harris Administration when they prosecuted and convicted moms, dads, grandparents, priests, and other nonviolent pro-lifers for peacefully exercising their First Amendment rights in advocating against the injustice of abortion. Now, with the repeal bill heading to the House floor, we have the chance once and for all to end this weaponization and fully secure justice for pro-lifers across the country.”

Bath has been working directly with Congressional leaders to educate them on the dangers of allowing the FACE Act to remain in place, providing hundreds of pages of legal expertise outlining the unconstitutionality of the FACE Act, briefing staffers, meeting with lawmakers, and highlighting the threat it still poses in the hands of pro-abortion state attorneys general across the country.

“While the Trump Department of Justice has deweaponized the FACE Act, the law’s tentacles stretch beyond federal government. The FACE Act gives radical pro-abortion state attorneys general, like New York’s Letitia James and California’s Rob Bonta, the power to take up the mantle of weaponized prosecutions against pro-lifers,” Bath added. “We urge Congress to pass the FACE Act Repeal bill and send it to President Trump’s desk, to end this overreach and restore rule of law in the United States.”

“If passed, it will be a transformational moment for the pro-life movement and fulfill President Trump’s campaign promise to end the weaponization of government against pro-life Americans. President Trump rightfully pardoned our pro-life clients, who were unjustly convicted and can personally attest to the consequences of radical activist prosecutors’ ability to twist laws to punish their political opponents.”

In courtrooms across the country, Thomas More Society attorneys have defended several peaceful pro-life advocates, such as Mark Houck, Paul Vaughn, and Lauren Handy against high-profile prosecutions. On Capitol Hill, Thomas More Society continues to advise lawmakers on the FACE Act, through legal analysis, briefings of members of Congress and their staff, as well as Congressional testimony from both attorneys and pro-life clients highlighting the tragic impact of Biden-era prosecutions. Representative Chip Roy’s FACE Act Repeal Act of 2025 now advances to a full floor vote in the U.S. House of Representatives.
