“YOUR RELIGIOUS BELIEFS DON'T MATTER”: L.A. COUNTY LIFEGUARD CAPTAIN BACK IN FEDERAL COURT: For more than two decades, Captain Jeffrey Little has served the people of Los Angeles County in the Fire Department's Lifeguard Division. But in 2023, when the County ordered captains to ensure the “Progress Pride Flag” was flown at their stations, Captain Little, a devout Christian, requested a religious accommodation. The County agreed, then reversed course within days. Six disciplinary actions followed in five days, culminating in a 15-day unpaid suspension. When his Division Chief hand-delivered the disciplinary paperwork, he told Captain Little to his face: “Your religious beliefs don't matter.”
Today, Thomas More Society attorneys return to federal court in Little v. Los Angeles County seeking partial summary judgment on Captain Little's claims of religious discrimination, retaliation, and violation of his First Amendment Free Exercise rights. Nearly three years after the original violation, Captain Little still has no permanent protection—every June, he must return to the table and ask permission to follow his religious beliefs, with no guarantee of an answer.
“When a county official tells a heroic public servant of more than 20 years that his religious beliefs don't matter and then defends that statement in federal court—that tells you everything about how Los Angeles County approached this issue,” said Paul M. Jonna, Special Counsel to Thomas More Society. “This was not a good-faith effort to balance competing interests. This was hostility to religion, plain and simple.”

SUPREME COURT LEAVES MAIL-ORDER ABORTION PILL IN PLACE—FOR NOW: This week, the U.S. Supreme Court paused a Fifth Circuit ruling that would have reinstated the FDA's in-person dispensing requirement for mifepristone, the first drug in the chemical abortion regimen. The order means that, while litigation in Louisiana v. FDA continues, the abortion pill will keep flowing into every state by mail, including states where abortion is otherwise prohibited by law.
Justices Thomas and Alito dissented. Thomas pointed to the Comstock Act, the federal law that prohibits mailing abortion-inducing drugs and noted that the drug manufacturers cannot claim irreparable harm from being prevented from breaking the law. Alito wrote that the unrestricted mail-order regime is part of a “scheme to undermine” the Court's Dobbs decision, which returned the question of abortion to the states. The case now heads back to the Fifth Circuit on the merits.

NATHAN LOYD JOINS NAPA LEGAL PODCAST TO DISCUSS LANDMARK COAST GUARD SETTLEMENT: Thomas More Society Staff Counsel Nathan Loyd, who is also a Lieutenant Colonel in the U.S. Air Force Reserves, joined Frank DeVito on the Napa Legal Podcast to break down TMS's recent landmark settlement with the United States Coast Guard in Jackson v. Mullin, an agreement that will protect the religious freedom of service members across the country for years to come.

NIFLA (National Institute of Family and Life Advocates) represents 1,700+ affiliated pregnancy centers across the country. Over the years, NIFLA and TMS have stood shoulder to shoulder in the fight to protect the rights of pro-life pregnancy centers and the women they serve.
